To understand the Muslim world it is essential to see it in a transnational context that is informed by its heterogeneity, power contestations, and continuous change. To understand human rights' foundations and origins it is essential to grapple with its legal, political, normative, and institutional groundings, and bear in mind its ongoing reconfigurations and global impacts. Each of these tasks is illustrated by how movements for the rights of women and sexual minorities have come to impact on the transnational Muslim (...) world and international human rights. This article explores each element within these complementary themes as a way of framing how and why the international human rights regime increasingly intersects with the Muslim world in a way that underpins challenges to authoritarian politics and the monolithic constructs of politics and society on which authoritarianism thrives. Taking Blair’s recent contribution to the debate about the triad as its starting point, the article discusses and challenges attempts to reduce the intricate relationship between rhetoric, dialectic and logic to a trichotomy with watertight compartments or to separate them with a single clear-cut criterion. I argue that efforts to pinpoint an essential difference, among the various typical differences partly grounded in disciplinary traditions, obscure the complexities within the fields. Both critique and an appropriation of a large and diverse body of work, Home and Beyond is a major contribution to contemporary Husserl scholarship.

Long used as a tool for medical compliance and adhering to treatment plans, behavior contracts have made their way into the in-patient healthcare setting as a way to manage the “difficult” patient and family. The use of this tool is even being adopted by healthcare ethics consultants (HECs) in US hospitals as part of their work in navigating conflict at the bedside. Anecdotal evidence of their increasing popularity among clinical ethicists, for example, can be found at professional bioethics meetings and (...) conversations and idea-sharing among practitioners on HEC social media. While there are a handful of papers gesturing toward a bioethical critique of behavior contracts of various types, the use of behavior contracts in the context of interpersonal conflict has not been vetted by bioethicists to determine their ethical legitimacy or efficacy. In this paper, we highlight a set of ethical concerns that we believe must be addressed before continuing or widespread implementation of behavior contracts to manage the “difficult” patient or family. Throughout much of the twentieth century, the relationship between analytic and continental philosophy has been one of disinterest, caution or hostility. Recent debates in philosophy have highlighted some of the similarities between the two approaches and even envisaged a post-continental and post-analytic philosophy. Opening with a history of key encounters between philosophers of opposing camps since the late nineteenth century - from Frege and Husserl to Derrida and Searle - the book goes on to explore in detail the main methodological (...) differences between the two approaches. This covers a very wide range of topics, from issues of style and clarity of exposition to formal methods arising from logic and probability theory. The final section of this book presents a balanced critique of the two schools' approaches to key issues such as time, truth, subjectivity, mind and body, language and meaning, and ethics. "Analytic versus Continental" is the first sustained analysis of both approaches to philosophy, examining the limits and possibilities of each. It provides a clear overview of a much-disputed history and, in highlighting the strengths and weaknesses of both traditions, also offers future directions for both continental and analytic philosophy. This study examined the role of reflection on personal cases for making ethical decisions with regard to new ethical problems. Participants assumed the position of a business manager in a hypothetical organization and solved ethical problems that might be encountered. Prior to making a decision for the business problems, participants reflected on a relevant ethical experience. The findings revealed that application of material garnered from reflection on a personal experience was associated with decisions of higher ethicality. However, whether the case (...) was viewed as positive or negative, and whether the outcomes, processes, or outcomes and processes embedded in the experience were examined, influenced the application of case material to the new problem. As expected, examining positive experiences and the processes involved in those positive experiences resulted in greater application of case material to new problems. Future directions and implications for understanding ethical decision making are discussed. (shrink)

In this essay I propose an environmental ethic in the pragmatic vein. I begin by suggesting that the contemporary debate in environmental ethics is forced into a familiar but highly restrictive set of distinctions and problems by the traditional notion of intrinsic value, particularly by its demands that intrinsic values be self-sufficient, abstract, and justified in special ways. I criticize this notion and develop an alternativewhich stresses the interdependent structure of values, a structure which at once roots them deeply in (...) our selves and at the same time opens them to critical challenge and change. Finally, I apply this alternative view back to environmental ethics. It becomes easy to justify respect for other life forms and concern for the natural environment, and indeed many of the standard arguments only become stronger, once the demand to establish intrinsic values is removed. The process of dehumanization, or thinking of others as less than human, is a phenomenon with significant societal implications. According to Haslam's model, two concepts of humanness derive from comparing humans with either animals or machines: individuals may be dehumanized by likening them to either animals or machines, or humanized by emphasizing differences from animals or machines. Recent work in cognitive neuroscience emphasizes understanding cognitive processes in terms of interactions between distributed cortical networks. It has been found that reasoning about (...) internal mental states is associated with activation of the default mode network and deactivation of the task positive network ; whereas reasoning about mechanical processes produces the opposite pattern. We conducted two neuroimaging studies. The first examined the neural bases of dehumanization and its relation to these two brain networks, using images and voice-over social narratives which either implicitly contrasted or implicitly likened humans to either animals or machines. The second study addressed a discrepancy between findings from the first study and prior work on the neural correlates of dehumanization: using a design similar to prior work we examined neural responses to pictures of humans, animals and machines, presented without any social context. In both studies, human and humanizing conditions were associated with relatively high activity in the DMN and relatively low activity in the TPN. However, the non-human and dehumanizing conditions deviated in different ways: they demonstrated more marked changes either in the DMN or in the TPN. Notably, differences between the animal dehumanizing and humanizing conditions were most evident in regions associated with mechanistic reasoning, not in the mentalizing network. Conjunction analysis of contrasts from both paradigms revealed that only one region was consistently more active when participants saw human, a medial parietal region regarded as the central hub of the DMN. These findings provide a neural basis for Haslam's distinction between two types of dehumanization, and suggest that the DMN and TPN play opposing roles in creating a sense of moral concern. Non-Identity arguments have a pervasive but sometimes counter-intuitive grip on certain key areas in ethics. As a result, there has been limited success in supporting the alternative view that our choices concerning future generations can be considered harmful on any sort of person-affecting principle. However, as the Non-Identity Problem relies overtly on certain metaphysical assumptions, plausible alternatives to these foundations can substantially undermine the Non-Identity argument itself. In this paper, I show how the pervasive force and nature of Non-Identity arguments (...) rely upon a specific adoption of a theory of modality and identity and how adopting an alternative account of modality can be used to reject many conclusions formed through Non-Identity type arguments. By using Lewis’s counterpart-theoretic account to understand ways we might have been, I outline the basis of a modal account of harm that incorporates a person-affecting aspect. This, in turn, has significant implications for ethical decision-making in areas such as reproductive choice and the welfare of future generations. (shrink)

Forty years of experimentation on class inclusion and its probabilistic relatives have led to inconsistent results and conclusions about human reasoning. Recent research on the conjunction "fallacy" recapitulates this history. In contrast to previous results, we found that a majority of participants adhere to class inclusion in the classic Linda problem. We outline a theoretical framework that attributes the contradictory results to differences in statistical sophistication and to differences in response mode-whether participants are asked for probability estimates or ranks-and propose (...) two precise cognitive algorithms for ranking probabilities. Our framework allows us to make novel predictions about when and why people adhere to class inclusion. Evidence obtained in several studies supports these predictions and demonstrates that the proposed ranking algorithms can account for about three-quarters of participants' inferences in the Linda problem. Frauchiger and Renner have recently claimed to prove that “Single-world interpretations of quantum theory cannot be self-consistent”. This is contradicted by a construction due to Bell, inspired by Bohmian mechanics, which shows that any quantum system can be modelled in such a way that there is only one “world” at any time, but the predictions of quantum theory are reproduced. This Bell–Bohmian theory is applied to the experiment proposed by Frauchiger and Renner, and their argument is critically examined. It is (...) concluded that it is their version of “standard quantum theory”, incorporating state vector collapse upon measurement, that is not self-consistent. (shrink)

Anthony Kenny, one of the most distinguished philosophers in England, explores the notion of responsibility and the precise place of the mental element in criminal actions. Bringing the insights of recent philosophy of mind to bear on contemporary developments in criminal law, he writes with the general reader in mind, no specialist training in philosophy being necessary to appreciate his argument. Recent legal rulings concerning the status of advance statements have raised interest in the topic but failed to provide any definitive general guidelines for their enforcement. I examine arguments used to justify the moral authority of such statements. The fundamental ethical issue I am concerned with is how accounts of personal identity underpin our account of moral authority through the connection between personal identity and autonomy. I focus on how recent Animalist accounts of personal identity initially appear to provide a (...) sound basis for extending the moral autonomy of an individual - and hence their autonomous wishes expressed through an advance directive - past the point of severe psychological decline. I argue that neither the traditional psychological account nor the more recent Animalist account of personal identity manage to provide a sufficient basis for extending our moral autonomy past the point of incapacity or incompetence. I briefly explore how analogies to similar areas in law designed to facilitate autonomous decision, such as wills and trusts, provide at best only very limited scope for an alternative justification for granting advance statements any legal or moral authority. I conclude that whilst advance statements play a useful role in formulating what treatment is in a patient’s best interests, such statements do not ultimately have sufficient moral force to take precedence over paternalistic best interest judgements concerning an individual’s care or treatment. About 25 years ago, it came to light that a single combinatorial property determines both an important dividing line in model theory and machine learning. The following years saw a fruitful exchange of ideas between PAC-learning and the model theory of NIP structures. In this article, we point out a new and similar connection between model theory and machine learning, this time developing a correspondence between stability and learnability in various settings of online learning. With his _An Interpretation of Nietzsche’s "On the Uses and Disadvantage of History for Life_", Anthony K. Jensen shows how 'timely' Nietzsche’s second "Untimely Meditation" really is. This comprehensive and insightful study contextualizes and analyzes a wide range of Nietzsche’s earlier thoughts about history: teleology, typology, psychology, memory, classical philology, Hegelianism, and the role historiography plays in modern culture. _On the Uses and Disadvantages of History for Life_ is shown to be a ‘timely’ work, too, insofar as it weaves (...) together a number of Nietzsche's most important influences and thematic directions at that time: ancient culture, science, epistemology, and the thought of Schopenhauer and Burckhardt. Rather than dismiss it as a mere ‘early’ work, Jensen shows how the text resonates in Nietzsche’s later perspectivism, his theory of subjectivity, and Eternal Recurrence. And by using careful philological analysis of the text’s composition history, Jensen is in position to fully elucidate and evaluate Nietzsche’s arguments in their proper contexts. As such Jensen’s _Interpretation_ should restore Nietzsche’s second "Untimely Meditation" to a prominent place among 19 th Century philosophies of history. (shrink)

This volume offers perspectives on the theme of surprise crossing philosophical, phenomenological, scientific, psycho-physiology, psychiatric, and linguistic boundaries. The main question it examines is whether surprise is an emotion. It uses two main theoretical frameworks to do so: psychology, in which surprise is commonly considered a primary emotion, and philosophy, in which surprise is related to passions as opposed to reason. The book explores whether these views on surprise are satisfying or sufficient. It looks at the extent to which surprise (...) is also a cognitive phenomenon and primitively embedded in language, and the way in which surprise is connected to personhood, the interpersonal, and moral emotions. Many philosophers of different traditions, a number of experimental studies conducted over the last decades, recent works in linguistics, and ancestral wisdom testimonies refer to surprise as a crucial experience of both rupture and openness in bodily and inner life. However, surprise is a theme that has not been dealt with directly and systematically in philosophy, in the sciences, in linguistics, or in spiritual traditions. This volume accomplishes just that. Contemporary nonanthropocentic environmental ethics is profoundly shaped by the very anthropocentrism that it tries to transcend. New values only slowly struggle free of old contexts. Recognizing this struggle, however, opens a space for—indeed, necessitates—alternative models for contemporary environmental ethics. Rather than trying to unify or fine-tune our theories, we require more pluralistic andexploratory methods. We cannot reach theoretical finality; we can only co-evolve an ethic with transformed practices.

According to quantum mechanics, statements about the future made by sentient beings like us are, in general, neither true nor false; they must satisfy a many-valued logic. I propose that the truth value of such a statement should be identified with the probability that the event it describes will occur. After reviewing the history of related ideas in logic, I argue that it gives an understanding of probability which is particularly satisfactory for use in quantum mechanics. I construct a lattice (...) of future-tense propositions, with truth values in the interval [0, 1], and derive logical properties of these truth values given by the usual quantum-mechanical formula for the probability of a history. For the lack of forty-nine drachmas Socrates was unable to attend the costly epideixis of Prodicus from which he would have learnt the truth about correct use of words. From Prodicus' ὥραι Socrates could also have learnt the concepts and characteristic words associated with arete and kakia: these compete in that work for the allegiance of Heracles, parading their respective characteristics. Thanks to Professor Arthur Adkins we have had for the past decade a book which not only confronts arete and (...) kakia, but also analyses the meaning and usage of many Greek words for the evaluation of action from Homer to Aristotle. The importance of this book is generally acknowledged but it has not received the detailed discussion it deserves. Professor Adkins finds the social structure of ancient Greece inimical to the development of an adequate concept of moral responsibility. He shows, in a most interesting manner, how Greek values changed as the needs of society changed. (shrink)

Trivers’s theory of parental investment suggests that adults should decide whether or not to invest in a given infant using a cost-benefit analysis. To make the best investment decision, adults should seek as much relevant information as possible. Infant facial cues may serve to provide information and evoke feelings of parental care in adults. Four specific infant facial cues were investigated: resemblance (as a proxy for kinship), health, happiness, and cuteness. It was predicted that these cues would influence feelings of (...) parental care for both sexes, but that resemblance would be more important for men than women because of the importance of paternity uncertainty in the ancestral environment. Seventy-six men and 76 women participated in a hypothetical adoption task in which they made judgments of infant faces. Average zero-order, partial, and component score correlations all revealed that men placed primary emphasis on cues of resemblance, while women placed primary emphasis on cues of health and cuteness (cues of infant quality). The correlations also showed that men placed a significantly greater emphasis on cues of resemblance than did women. (shrink)

We might begin by trying to unsettle the apparently natural inferences that are supposed to lead us so ineluctably to recognize something called “intrinsic value”.

This paper takes what has been termed the “epidemic of obesity” as the point of departure to examine the way in which political economic factors intersect with diet and nutrition to determine adverse health outcomes. The paper proposes several concepts to better understand the dynamics of the “foodscape” – institutional sites for the merchandising and consumption of food. These include the concepts of “spatial colonization” and “pseudo foods.” With a focus on critical dimensions of the contemporary “foodscape,” principally supermarket merchandising (...) practices, as well as trends in other food vending operations, the paper explores incentives that motivate capital to “spatially colonize” the foodscape with aggressively promoted high fat/high sugar “pseudo foods.” The paper reports on extensive research on trade industry publications as well as data collected through onsite investigations of supermarket practices of the three largest Canadian retail supermarket operations. In addition, current merchandising practices of convenience chain store operations and some non-traditional food vending sites are examined. In concluding, it is argued that the rapidly evolving interdisciplinary debate around the obesity crisis would benefit considerably from the insights to be gained from political economic analysis of retail food industry practices and trends. W.V. Quine is committed to the claim that all beliefs are rationally revisable; Jerrold Katz has argued that this commitment is unstable on grounds of self-application. The subsequent discussion of this issue has largely proceeded in terms of the logic of belief revision, but there is also an issue here for the treatment of Quine’s views in a doxastic modal system. In this paper I explore the treatment of Quinean epistemology in modal terms. I argue that a set of formal (...) revisability desiderata can be distilled from Quine’s epistemic writings, and that there are demonstrably coherent and non-trivial systems that meet these conditions.
